Northern Ireland’s official government guidance, for example, explains that if a person living in Northern Ireland needs a document showing freedom to marry abroad, they should apply for a Certificate of legal capacity to marry, also described as a Certificate of non-impediment. It also states that the certificate is sent after at least 28 days have passed once the marriage notice form has been submitted.
This example shows why UK couples should not assume that every part of the UK follows exactly the same operational procedure. The Italian requirement may be the same in principle, but the UK-side route to obtaining the document can differ.
Timeline to Get CNI for Italy Wedding
A legal wedding in Italy should not be treated as a last-minute paperwork exercise. The timeline depends on the local UK office, apostille processing, translation, Comune review, and the wedding date.
A practical technical timeline is the following.
Several months before the wedding
Confirm the wedding venue, the Italian Comune, the ceremony type, and the exact documents required. Ask whether the Comune needs original documents in advance, scanned copies for pre-check, sworn translations, interpreter details, witness documents, or municipal fees.
Before requesting the CNI
Check passport names and personal details. If one partner was previously married, confirm which divorce, annulment, or death documents are required. If one partner has dual nationality or Italian citizenship, ask whether the ordinary UK CNI route still applies.
CNI phase
Give notice through the correct UK authority or follow the GOV.UK route indicated for your residence situation. Once the CNI is issued, check every detail before legalisation.
Statutory declaration phase
Prepare the bilingual statutory declaration, sign it before the appropriate professional, and make sure it is consistent with the CNI and passport.
Apostille phase
Send the documents that require legalisation to the FCDO Legalisation Office. Keep enough time for processing, delivery, possible corrections, and onward submission to Italy.
Translation phase
Arrange Italian translations only in the format required by the Comune. If a sworn translation is needed, confirm whether it must be completed in Italy or whether another official route is accepted.
